This warranty does not cover any damage caused by the use of other than genuine manufacturer’s parts and consumables.

Please be sure that ‘The Product Warranty’ is not transferable. It is limited to the original purchaser specified in the original Sales Order at the original delivery address only.

To the maximum extent permitted by law, Fabulous Australian Trade Pty Ltd is not liable, whether in contract, tort (including negligence), under any statute or otherwise, for or in respect of:

a) Normal wear and tear of the Leather Product

b) The natural characteristics of the Leather Product:

Leather is a natural material, so every hide has unique characteristics; and as our furniture is made from many hides, the leather may show slight color and grain variation - this is only natural.

Age adds character and reflects how the leather furniture has been used during its lifetime. Over the years, leather adapts itself to the user and develops a personalized and individual look.  With regular use, as the leather fibers relax, we expect that comfort creases may form in the areas that receive the most body contact, such as seat and back cushions. All these signs serve as more evidence of the leather's authenticity and should be no cause for concern.

The naturally changing patina of some premium leather finishes

The less surface treatment your leather has, usually the softer and more natural it will appear and feel. Pure aniline and some semi-aniline finishes, as well as leathers with a ‘waxy’ or ‘pull-up’ finish, will continue to change appearance as the leather ages, responds to your lifestyle and the way you use your furniture.

Most common characteristics in premium leathers:

Vein Lines, Horn Butts, Scrapes & Healed Scars, Fat Wrinkles, Skin Blemishes, Color Variation and Grain Variation

Scars, wrinkles and folds all contribute to the natural beauty of top grain leathers and do not affect the performance or longevity of the leather. The appearance of these characteristics varies from minimal to prominent, depending on the hide selection and processing. Dyes are absorbed differently throughout the hide and some color variation is normal and expected. Color variation ranges from slight in pigmented top-coat protected finishes, to distinct, in semi or full aniline finished leathers, with no color pigments.

c) damage caused by spills such as acid, solvents, dyes or other corrosive materials, ink, paint, or bodily fluids; or

d) damage caused by improper cleaning, negligence, treatment of the Leather Product with chemicals, exposing the Leather Product to the sun, extreme heat or bright light such as lamps, or otherwise caused by your acts and/or omissions; nor the cost of transporting the Leather Product to and/or from the specified place of repair or replacement.

e) the cost of transporting the Product to and/or from the specified place of repair or replacement.

You acknowledge and agree that the Leather Product is upholstered by hand and therefore, the size and weight of the Leather Product may have minor variations of up to 5% from the sample product or from any product specifications you have been quoted.

Our goods also come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Except as set out in these Conditions of Sale and Warranty and under the Australian Consumer Law and subject to any condition, warranty or right granted or implied under any other law, which cannot by law be excluded by agreement, Fabulous Australian Trade Pty Ltd will not be liable, whether in contract, in tort (including negligence), under any statute or otherwise, for any loss or damage of any kind suffered by you or any other person in connection with the goods including, but not limited to, indirect and consequential loss.

a) 5 years for upholstery frames (including sofas, beds, chaise,Wardrobe, TV stands, Dining table, Office desk and Computer desk, Bookcase and excluding chairs and bar stools);

(b) 2 years for furniture (including upholstery furniture coverings, foam, finishing (stitching, glue, zippers, padding nails, tacks) and recliner mechanisms), pendant lights and any other product which Fabulous Australian Trade identifies in writing as attaching this Warranty; and

(c) 1 year for all other products.
